These terms cover your use of the Simply Balance Android application, published by Cypress Technology, a brand of Cypress Technology LLC. Installing or using the app means you accept them. If you don't, please uninstall it.
Simply Balance is not medical or nutritional advice. Its calorie and macro targets, maintenance estimates and weekly adjustments come from standard formulas and the numbers you enter. They are estimates for general wellness, not a diagnosis or a treatment plan. Talk to a doctor or registered dietitian before changing how you eat, especially if you are pregnant or breastfeeding, have or have had an eating disorder, or have a medical condition.
Your log lives on your device, and only you have it. We hold no copy. If you uninstall the app or clear its data, it is gone permanently and we cannot recover it.
You get a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you control. You may not sell, rent, redistribute, decompile or reverse-engineer it, or remove any branding, except where the law says such a restriction cannot apply.
Simply Balance is for adults aged 18 and over.
Simply Balance is free to download and use, with one banner ad. Premium is an optional one-time purchase through Google Play that removes the ad and unlocks the Nutrition-label scan. Its price is shown in the app before you buy; Google Play handles payment and refunds under its own policies. A purchase is tied to your Google account: use Restore purchase in Settings → Premium after reinstalling or on a new phone.

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any defect will be corrected.
To the maximum extent the law allows, Cypress Technology LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the app — including a decision about diet, weight or health made on the basis of anything the app displayed, or a lost log.
Where liability cannot be excluded, it is limited to the greater of the amount you paid for the app in the twelve months before the claim, or USD 10.
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, and your statutory consumer rights are unaffected.
We may update the app or these terms. Material changes will be reflected in the date above. Continuing to use the app after a change means you accept it. We may discontinue the app at any time; if we do, it will keep working on devices where it is already installed.
These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law rules, and the courts located there have jurisdiction — except where the mandatory law of your country of residence gives you the right to bring proceedings locally.
