These terms cover your use of the Simply Radar Android application, published by Cypress Technology LLC. Installing or using the app means you accept them. If you don't, please uninstall it.
Arrival times are estimates. Simply Radar is not a warning system. Radar imagery is minutes behind real time. Storms change speed, direction, size and intensity without notice; they split, merge, form and die. The app measures where a cell has been and projects where it is going — it cannot see the future, and its confidence rating is a description of how steady the past few frames were, not a guarantee.
Follow official National Weather Service warnings and local emergency instructions. If a warning is in force, act on it — do not wait for a countdown in this app to reach zero. Never use the app as the sole basis for a decision that affects safety.
You get a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you control. You may not sell, rent, redistribute, decompile or reverse-engineer it, or remove any branding, except where the law says such a restriction cannot apply.
Notifications depend on Android's own delivery and on the permissions you grant; location depends on GPS, network conditions and battery settings. Either can be delayed, inaccurate, or absent. Treat them as a convenience, never as the thing standing between you and a consequence.
Simply Radar is free and supported by a single banner advertisement; the free tier measures to your current GPS position. Premium is a one-time purchase through Google Play that removes advertising, lets you place the target anywhere and save named locations, and unlocks every radar update interval.
The free tier shows advertising served by Google AdMob. We do not choose the individual adverts and are not responsible for their content or for any site they lead to. What the advertising SDK collects is set out in the Privacy Policy.
The base map is Google Maps and is subject to Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Radar imagery and alerts are US government works provided by NOAA and the National Weather Service; Simply Radar is not affiliated with or endorsed by either.
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that it will be uninterrupted, error-free, timely, or that any defect will be corrected, and we make no warranty about the weather data it displays.
To the maximum extent the law allows, Cypress Technology LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss, injury, or damage to property arising from your use of or inability to use the app — including reliance on an arrival estimate, a missed or late notification, or radar or alert data that was delayed, wrong, or unavailable.
Where liability cannot be excluded, it is limited to the greater of the amount you paid for the app in the twelve months before the claim, or USD 10.
Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, and your statutory consumer rights are unaffected.
We may update the app or these terms. Material changes will be reflected in the date above. Continuing to use the app after a change means you accept it. We may discontinue the app at any time, and the public data services it relies on may change or end without notice to us.
These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law rules, and the courts located there have jurisdiction — except where the mandatory law of your country of residence gives you the right to bring proceedings locally.
